I’m really frustrated. We have a Bank Of America checking and savings account that rarely used, and was lower than we thought. Low enough that when we went to Redbox to get 5 movies, the money wasn’t available. What does Bank Of America do? They authorize my debit card. Why? Because they get $35 for each overdraft. It’s in their best interest to let that purchase go through, because they pretty much have a sure $35 bucks for a fee.

Ok, I get it. I goofed. I’ll pay the $35 fee. That’s reasonable.

I know it’s a devious policy, but I shouldn’t have used a card that I had no idea what was on it. If I had used any other card I wouldn’t be writing this. So I’m willing to cough up the $35. But that’s not enough for Bank Of America. It turns out RedBox has an interesting method of charging you. They bill you 1 time per movie, even if you only swipe your card once. So I rented 5 movies, $1 each. Redbox dings my card 5 times. What do I care? So Bank Of America decided to charge me 5 individual overdraft fees of $35 each. Now I care.

Of course, we thought Bank Of America would be willing to discuss this situation and come to some sort of reasonable resolution. Nope. They removed a single fee and said that’s all they could do. The guy on the line, a supervisor that we requested, went so far as to say “Sorry, It’s Not Our Policy To Cancel Fees To Keep Business Or Please Customers”. I shit you not, I hope they have a recording of it. He also said that they have arrangements to pay these vendors, so that means the vendors are probably paying extra for some hidden service that allows them to tap into overdrafts. Because of these arrangements, BOA’s computer had to all the hard work of giving $5 to Redbox, and BOA’s supervisor told me that’s why I was charged $35 X 5 ($175). Oh, $175 PLUS the original $5. Even more, he blamed RedBox – Said it’s their fault and that I should get them to take back the money.

So we kept on fighting the Bank Of America regime throughout the next week, unwilling to deposit  a couple thousand dollars worth of checks collected from fathers day, birthday, even a couple Christmas gift checks…all saved for our upcoming wedding. We aren’t willing to lose that money because BOA wants to play hardball over $5 fucking dollars.

We looked hopefully every day at our statement hoping the error would be fixed, and to our surprise we saw more $35 charges. Erin and I both turned our heads towards that mischievous debit card, which was sitting quietly on the kitchen table, trying to look innocent, as if to say “It wasn’t me, I swear”. So we looked closer – we were being charged 3 more times for having a negative balance for several days, several times. While we were fighting the fees, BOA said “You want to fight? Take this!”, striking us from the left, the right, the left, each $35 fee bringing me closer to my knees.

Down, But Not Out. I Can Play Dirty Too

So I’m a man of principles. Don’t take something that’s not yours. BOA is doing this to it’s customers in plain sight,  so I’m going to NOT WASTE MY TIME trying to talk to their call center employees.

Here’s what I AM going to do.

  • I’m going to write this blog post, and probably many others.
  • I’m investing 1/2 of the money BOA wants in fees to market this post on 3 major social media websites.
  • I’m going to tweet the hell out of this post, follow anyone who has a problem with BOA and keep this discussion going. BOA will surely lose at least a few hundred customers this year because of my efforts. I wonder how much that’s going to cost them?

    Bank of America has horrible customer service. Anything you can do to take business away from them I'm all for. They report a missed payment on my mortgage by mistake. Then when they reported the correction they used the wrong account number. After being on the phone with them for more than 6 hours over the course of 5 days (and having to pay an outside agency to pull my credit to prove it to them) I got the problem resolved. Total BS. And who am I going to call and complain. I say shut them down....don't Bail them Out

    same thing happened to me with paypal. paypal has a setup where if you don't have money in one account they try the next account. well, BofA paid it! then dinged me. again and again and again. Now the account is over $300 in the negative. Just stopped using it. They'll close the account eventually. If they want to. I've moved on...

    I LOVE YOU MANNNNNNNNN! To hell with BOA! Listen to this. I have stories but here are some things that stick out. I had an associate look at my statement and say "Mr.James i cannot explain to you why you were charged this overdraft fee. Here is another one. "HMMMMMMM, I've never seen this before". What the hell. The bankers themselves don't even know whats going on. My wife was charged, she went into the bank to speak with someone. The associate found no wrong doing on my wife's part and gave her the money back. A week later the bank writes a letter and says " our associate was incorrect in their assesment. We will have to deduct the fees again! LOL LOL LOL LOL LOL WOW!

    I am so fed up with Bank of America, I use to work for banks and so you would think I know the banking system since I worked for a bank for 10 years..These guys have a corrupt system...I know for a fact they are holding charges and putting it through when you have a lowest possible balance in hopes you will over draw...happens to me every wednesday before I get paid..... Now the weasals cleared a person check that I gave someone at 5:30pm. They have a 7:45pm cut off time for transactions but mind you none of the F****ng banks are open then so how they hell are they clearing a check I wrote at freaking 5:30pm to a person....It is not like her bank is open so it had to be through an ATM. What kinds of BS is this.....I am through with B of A....they have ATM on every corner but you paid for them and all the stupid BS fees and rules like this they should be on everycorner. I rather pay a 5.00 fee for withdrawing an a non bank ATM w/ someone else. The convience doesn't matter if they are going to rob you of the money and cant use the flipping thing!

    A few simple words of advice. Dump BofA now!!! I've been free of these morons for a year now. I'm so much happier. Move your money to a credit union. It's funny how many times BofA screwed me with these fees. They make you second guess yourself, making you feel that your mismanaging your money. Since moving my money, I've yet to over-draw my account. Made me wonder who was really mismanaging MY money. What was really the icing on the cake for me to get out was BofA lowering my line of credit by $4000 on my credit card. Then they raise the intrest rate to 29.9%. I also transfeered my money from my credit card to a credit union line of credit at excellant intrest rate. Closed BofA credit card account even though my credit score takes a hit. F--- them I'm free from their crude practices and no longer trapped by their bottom feeder mentality. Get out and get out now you won't regret it. For those of you that are walking away from your negative balances. I advise against it. If you do walk away open an account at another institution quickly or you will not be able to open an account anywhere. BofA will report you to a bank reporting agency. This will put you on a blacklist that all banks use when you open an account. If you are on the list you'll be denied an account and really screwed for seven years. Just like a ding on your credit report but I view it as more severe since you'll be unable to open an account anywhere. Again run and run fast from these crooks. You'll never be happier. The more of us that leave them the harder they'll fall.

    BOA Online banking told me I had 5 dollars left on my account even subtracted from pending check hold and i had 100 IN SAVINGS so i INSTANT tranfered 100 bucks to buy 7 things on christmas eve. Well i have a merry christmas three days later when i saw that my tranfer wasnt actually instant and i was charged 7 35 dollar overdraft fees ...because i my instant transfer wasnt as instant as they claim.

    Down with the Banksters! They did the same to me; first they charged me an overdraft fee then because the same fee took me to a negative balance they hit me with a second fee; $70 for $2 in the red. So I decided that my other accounts are in good standing and seven years isnt long to wait, so fuck 'em, I'll take the credit ding and keep my money. Maybe if enough of us simply walk away from our (fee created) negative accounts it will open their eyes. Lesson learned: don;t put another dime in your BofA account, they will conspire to take it away from you. Remember: it was YOUR money to begin with.

    My story's similar, except I think mine beats yours in the WTF?? department! I had a $2.35 transaction that I was in the middle of switching banks and forgot my Itunes was still linked to BOFA acct. There weren't sufficient funds in checking, but there was $1 +change in savings. They took that, paid some of the $2.35 original transaction with it, charged me $35 NSF charge PLUS a $10 transfer from savings acct. fee! The fees just kept adding up until I finally did what you did...just stopped depositing anything in my account for fear they would steal it. I'm beginning to think that my Grandpa that kept his money under his mattress wasn't so crazy after all :)

    they did similar stuff to me and I told them give me my money back or I am complaining to local state Representative and the federal reserve. They sometimes like to send the big purchase through and then small purchases that you made a few days earlier they hold back and then send those after wards then you go over three small purchases then get charged the overdraft fees on three things instead of one

    We are having similar issues with another banking instution (notice the choice of the word, instution. They should all be instutionalized!) Charging a $35 fee on a single $9 transactrion, that fee screws the account up even further, once the overdraft and the new negative is going on, they can then charge $35 for every 5 days that it's overdrawn. I'm NOT going to pay any of the fees! I'm going to put the $9 (and any other charges that they are legit) into the account and going to another bank. I will warn them what has been going on in the past and then give them the hint that I won't hesitate to do that again.

    By the way I'm going local in everyway I can starting with my bank;when you realize you're in an abusive relationship get out!Unfortunately the majority of my limited income comes from ebay;then paypal;then bank of america so i have been SCREWED from here to sunday at every step by everyone;I'll consider myself lucky if i don't wind up homeless and suicidal;Lucky for me I still have a sense of humour.

    I'll tell you i think violence is over-rated but visions of the french revolution roll through my head when i think about BOA.Let me preface this with the fact that I am beyond financial collapse;I have gone without food because of BOA;I have gone without food for days as a direct result of BOA!!!!Back in mid january I checked my balance at the ATM at BOA and they said I had $16 in my account so i sauntered over to slaveway and purchased $13 in food;nice thing when you are literally starving-no joke!I was charged for an overdraft fee since unbeknownst to me between walking across the street to buy food they charged me The $8 for my checking account...so for $13 of food I was not only charged the $35 overdraft fee (I have repeatedly told them to stop covering overdrafts!!!!!)Then 6 days later I was threatened with another $35 fee for an "extended Loan";needless to say I couldn't pay the $35 let alone $70 for a one week loan for $8 fricken dollars.Loansharks aren't this bad are they?Take these basterds down!!!

    BofA is truly scum – total bottom feeders – embarassing that I stayed with them for as many years as I did. I’ve been reamed for overdraft fees for years but stubbornly thought I could figure out how to prevent them from recurring. That last straw, which finally broke my back, was incurring over $400 in fees because I was 5 days late in paying my overdraft protection. I had almost $4000 in available credit available for overdraft protection but because I was late paying the $32.00 that was owed to that account they blocked the overdraft protection and I incurred fees for days – even AFTER I got everything caught up. Absolutely insidious. I’m starting the process of switching to a local bank today and as painful as it will be tracking down all the automatic transactions I’ve set up over the years it will be SO worth it to leave BofA behind.

    Love the story of (but feel bad for) the person who got screwed by the RedBox rentals – I’ll be sure all my friends know about that!

    Bank of America sucks. They charged me $280 in overdraft fees for a few minor transactions. Of course, the processed the charges not by date of occurrence, but by largest to smallest. Bastards. I paid it off and closed the account. A month later I get a call from their 800 number; the rep told me it was a courtesy call to remind me that my checking account (the one that I closed the month prior) was overdrawn by $12.50. I asked how was that possible? She said the charge was an account maintenance fee. I asked her how could BofA charge an account maintenance fee on a closed account. Do'H! I read her the confirmation number from my statement that I received from the branch when I closed the account. At which time she apologized profusely. I told her that there was no need to apologize- just refrain from calling me ever again. Bank of America can go screw. They're crooks. All crooks!

NEXT THING WE KNOW, A WEEK AFTER THESE TRANSACTIONS, HE RECEIVES A LETTER SAYING THEY ARE CHARGING HIM $50 IN OVERDRAFT FEES - IT'S LIKE W-H-A-T???????? TO MAKE A FRUSTRATING STORY SHORT, THEY FREAKING CHARGED HIM $250 IN 'OD' FEES FOR GOING $20 OVER & LETTING IT RIDE BECAUSE THEY DIDN'T NOTIFY HIM RIGHT AWAY.     we had a very similar incident with BOA. My wife and I recently got married and we were closing out her account with BOA She decided to use up some of the money that was in the account, turns out she had less than she thought. Made a couple of $5 dollar purchases and got hit for $300 in fees. Call BOA they said it was a courtesy to her to allow the transactions to go through. She said its not a courtesy to her but to them We fought and fought, had lawyers call and write letters and nothing. We've been fighting with them for 6 months now. I have a loan through them. It is suppose to be a fixed rate loan. Today I got a letter from BOA saying that the were changing it to a VAriable APR. I called and asked why, I have never been late on a payment or anything. She (Lisa F out of the California call center) said that they were doing it to everyone. I asked isn't the purpose of a fixed rate loan is to have a interest rate that doesn't change, She said yes but we reserve the right to change it at any time. I finally got through to her Supervisor (Maria Hayward) and she said (and I kid you not) "that they were changing everyones rate to Variable so that they can make money" If BOA would quit screwing people then they would have customers and not have to screw the customers that they have. Something needs to be done to put BOA in there place

    Yaaaaayyyyy!!!!!to you. Here's another one. Today BofA "honored" us with taking a 'hold' off a deposit we made 9/12 (day after step 1 of post masectomy reconstruction surgery). Obviously BofA thought we little po'folks, could not possibly attain such funds legally, so only a small part of the full sum was released. We have to wait until 9/23/09 for the remainder (the big $) to be taken off hold. Because of this hold our credit rating is probably O and other credit cards are late. This morning (9/19) I look on-line to see if they really really let me have my own money and find I was charged $35 for insufficient fees on 9/18 for a $30 co-pay to Kaiser for a required post surgery doctor's visit. Wow, Bank of America is such a warm and fuzzy institution. Why do I want to crash thru the doors w/ a camera crew and rip off my blouse (so they know I'm not making up the medical stuff) and scream AH HA!(then what?) Are we only to blog about it? Who can help us?

    I just got slapped with a $400 plus overdraft fee. BOA has a way of making your account overdraft. I told them that they should show my account being negative first (as a proof that when I made a certain trasncation - i have no available funds to cover that transaction) before they charge the overdraft fee. So, after they charge their overdraft fees,your account becomes negative.

    This same thing happened to my 20 year old niece. She was slapped with a $900 plus overdraft fees. BOA knows that there are no more funds. So after these $900 plus overdraft fee, my niece who does not check her account online and unaware that her account is already overdraft, still used her card. With the authorization of BOA. WHy! So, they could charge more overdraft fees. So, NOW - my 20 year old niece owes BOA over $1000. Seriously, does BOA really think that we will pay this. NOOOOO WAAAAYYY!!!!

    Long story short....I was the victim of identity theft through paypal. Through a series of 15 $150 charges, $2250 was the total that was trying to be taken from my account. I end up accruing a total of $960 in overdraft / NSF fees. Since then, after reporting both parties (paypal/BOA) to the BBB, they have refused to return these fees. Keep in mind, this is after they realized my account had been hacked. The customer service rep actually said that "with this current economy, they weren't in a place to lose money and return the fees".

    I propose it's time to do a documentary about these criminals. Anybody down for a project?

    I jsut got whacked $490.00 in fees for 14 overdraft charges...when I saw the charges pending, I deposited cash to cover it. I walked away with a positive balance, next day they nailed me with 35.00 fees on charges that were all under $20.00.
    I want THEM to pay...I know of no other bank that operates like this...with the FTC do anything about this???

    Yes, the bank does take advantage ofpeople. I justwas hit with $250.00 for $40.46OD. They gave a $35.00 fee for 7 transactions that added up to $78.00. I called and said hey, I am only$40.46 over. They did not have an answer but said that "the way we would run a bank is different then the way BOA does." This is robbery. The Class action lawsuit settled did not change them.
    Consumers need to agree on a date to close their accounts if the bank does not change. All of us on the same day. The gov. can't help, it is up to us, "we the people." We want business to make a profit but fairness and ethics need to reign.

    I live check to check and because of their moving around and processing tricks I have pulled 16 overdrafts which equals about 2 weeks of pay...... I am going to starve, miss rent, miss my insurance, and God knows whatelse.... and the only thing the call center said is tough shit basically.. I just wrote my representative, and wrote all those in the email list above.... lets hope something works out....

    Adding my 2 cents...I have been a customer for 4 years, never overdrafted, check my online account at least once a day, and know the difference between pending and processed. Last Monday I checked my account and everything had processed. I made a deposit of 430 in their automated teller to cover an online payment that was to come out that night. Check my account Tuesday, everythings fine, Wednesday, again fine. Thursday, I have NINE overdrafts! Called BOA, was told that the transactions were not actually processed, and were still pending, and that it was up to me to click the link to the left (wtf?) and I would have known that. Of course they took the largest amount first, so everything else would overdraft. One was a 1.10 redbox fee, that I had rented the week before! Dont tell me it takes a week for 1 10 to post! The very rude rep proceedes to 'lock' my account so no one else could help me. I called the main branch (she was very sympathetic but advised me my account was locked so she could do nothing) and gave me a # to a hardship line. They refused to help. Last night I emailed c/s and was told nothing they could do either. Not sure what Im going to do, those fees are going to add up, 9 overdrafts every 5 days, sickening. Luckily I was able to cancel my direct deposit, so they wont be taking my paycheck. Add me to the BOA haters club!

    Yep Yep! Fuck Bank of America! They pre-approved us for a $125,000 house. We then drove 10 hours one way and found a $70,000 house we like. We paid the $400 application fee to Bank of America, and about a half hour later, an underwriter called to tell us he denied the loan. (found out it was because of an INCORRECT report submitted JUST THIS WEEK on our credit report!!) The party involved even called our new loan officer and faxed a letter of confirmation to rescind the offense..... (it never happened and they didnt know how they got on my credit report.) But Bank of America wouldn't even listen. We have over $191,000 assets in 401K, IRA, pensions, stocks, etc. (AFTER subtracting what we still owe, which is JUST our current mortgage.) We got the credit cards paid off, cars paid off, EVERYTHING!! You would think THAT would be good enough, but noooooooooo. Fucking BASTARDS!!! But that's okay... their closing fees were up to $4400 dollars anyway, so they actually did us a favor. I found a company that gives me a ballpark closing figure of about $2000. Bank of America can kiss my big fat ass!

    Omg, they got me about a month ago. I was so frustrated and mad I felt like crying. First of all I had overdraft protection taken off of my acct so it would decline my card if I didn't have money in my checking acct, because I know they do weird little stuff because they got me so many times before. So I'm like you know what....take it off. So o/d protection had been off my acct for about a year. Then about a month ago I just checked my acct online like I always do and they had 3 $35 o/d fees on my acct. I'm like wtf? I don't even have overdraft protection, on top of that I monitor my acct if not daily, every other day. But they changed some transactions around I kid you not, and did some weird stuff to where I couldn't even understand after they explained it to me like 10 times. I follow every transaction I make. Then they said well it's not our fault, you should keep a registry because ur acct online and when you call isn't gauranteed to be accurate. I'm like wtf? What's the point in calling and checking it online if you're not gonna give me my correct balance? They just kept saying that's why I need to keep a registry. A. Why are you giving me a false balance? and B. why are you switching transactions around on my acct when things have already cleared? They wouldn't even take one of them off! I haaaaate them!

    We have been Bank of America customers for 18 years, used to be Nationsbank. We have over $300,000 in our personal accounts. We also have a business account, each month our business deposits over $300,000 for at least 8 Years. We arent rich because we turn around and put that money back in our business. Guess what, last month they decided to hold EVERY single deposit we make. WTF????? They our holding our big check for fourteen days!!!!! Now we cant pay our vendors and they are angry! Why after 8 years of the same frickin deposit do they want to place a hold all of the sudden? So they can get NSF fees... Jerks! I absolutely LOATHE BofA! So it's not only regular people that get screwed, it's businesses too!

    Could someone just say "HIJOS DE PUTA"......SCREW BOA. I had an issue with them 4 years ago and they closed my account...now the company I have worked for the past 1 years starting to pay me via direct deposit and they bank with BOA...so my direct deposits do not get to me on time or they would send them back to the company saying that their fraud department would not let the deposit happen!!!....   • Well here is an interesting new change that seems to have been implemented recently. Transfers between accounts are NO LONGER INSTANT! Yea thats right... you used to be able to transfer money between accounts to prevent overdrafts when you suddenly notice "pending" charges that you didn't account for. Well now, the transfers between accounts ALSO show "pending" so that at midnight, they can screw you over again by batching the pending debits BEFORE the now pending transfers (credits) thus causing as many $35 fees as possible.

    So I already hated BOA before I read this blog. However, I cannot sleep at night because recently my bank account disappeared. I shit you not, I had a bank account (that I requested be closed because I got a new account with them) with a total of negative $175 in fees. Not sure how that happened, I thought I was using checks from my new account they had just made for me. Anyhow the point is, the account is gone. I went to check on it the other day and it was gone. When I called it said they didn't know of that account number. I have no idea what this means, can anyone tell me??

    YES Skank of America will pull out the King Kong of (pardon the language) DILDO'S and screw you deeply without lube. They wait for low balances and then rearrange what has cleared to pending so that what would have been one or no overdrafts becomes 5 to 8, even if you deposited cash to cover it the same day. I've been with them for 6 years and they were great until my income changed and money was tight. Now I have to play cat and mouse game with them all the time.

    I am sick and tired of having to keep a close watch on Bank of America- every time I use my debit card something inside me prays that I dont get screwed this time around. You name it they have done it to me! they gave me a credit card that I had NO idea about!!! it wasnt mailed to my house, it wasnt activated, it was just linked to my chacking account that would cover my over draft- I had no idea!
    I am sick of it!!! What can I do? is there a way we can ALL close our Bank of America Accounts in ONE DAY? ALL 500 of us? That should make news right? someone? anyone? please- help me I feel violated and I have no help!

    There's another shady business practice that BoA is using to get more fees. They have begun charging an NSF fee upon the transaction instead of when the item actually posts to your account. What happened to me was admittedly an error on my part to start paying bills before verifying my balance. However, I realized my mistake within an hour and deposited the money to cover all of the transactions I had just made. Since everything was supposed to post after midnight (or so I thought), I was ok. Several days later, I began to receive NSF fees for the transactions I had made even though the last transaction I made was a deposit which covered all of the transactions I made. What's worse is that the debit transactions I made didn't post for several more days after the deposit. Of course I called customer no-service furious and they explained to me that theire "new" policy was to charge a fee upon the swipe of your card if the funds weren't there at the time...not when the line item actually posts. They severly penalize you for making a mistake. We're all human and subject to a mistake here and there from time to time. Your financial institution shouldn't bend you over when you do. Oh and needless to say, they didn't refund a cent and that's after going to the local branch and talking to customer no-service. Screw you BoA, I'll be taking my money elswhere. The shoebox and under the mattress ideas don't seem so bad now.

    Update... I sent an email to the email addresses listed above explaining my situation. Two days later I received several calls from the VP of Customer Marketing. And again today to make sure everything was ok. To make a long story short... they have refunded me the funds and stated just how sorry they were for my bad experience.

    FYI... Sending the email worked for me perhaps it will work for you as well. Give it a try, it's worth it! I'm not saying that we are having a love affair or anything but, I did receive my money back and for that I am grateful!

    The banking industry is REALLY bad and they are taking advantage of us we have to take a stand!

    Send your letters! They need us to keep their businesses afloat!

    This has happened twice:

    My husband deposits his paycheck into our account on Thursday (the day he gets it) INSIDE a physical BoA location. Three or four days later... it's still "pending." What the f-ck is the point in going inside a physical location if your money isn't available within 8 hours of deposit?

    And the first time this happened, I didn't think anything about it because it came up as "available" in the online banking window. So what did I do? I started paying bills. I finished by paying my credit card bill (another a$$hole bank: Chase) and went about my day.

    Three days later, I'm getting collection phone calls. Four times a day! From CHASE! This was the first time I had EVER been late or over my limit since I got my first credit card 5 years ago. So I get on my Chase account... my payment has been returned. So I have the returned payment charged back onto my account, a late fee, a returned payment fee, and now an over limit fee because the gazillion bucks in fees have screwed me over. And I go to the BoA account. A f-ing overdraft fee there too! There was money (to the tune of 3x of what the card payment was) in the account when I went to pay the credit card bill. What gives? How does that even happen?? There isn't even a record of the credit card payment even TRYING to go through! Now I've got two banks pissing me off.

    And again. A week later, I decided not to trust the available funds b.s. on the online banking. Husband's paycheck is STILL PENDING. FOUR DAYS LATER! I'm hoping and praying to G-d that the five transactions after the paycheck went in don't clear before the paycheck does. Judging by all the other comments here, it looks like we'll probably end up with five more overdrafts.

    I miss my credit union. I never had problems like this. That's the only negative thing about us moving about three hours away from our last residence.

    I have been Screwed out of hundreds of dollars buy this Damn bank But no more! I'm going to the Credit union. I asked BofA once if the could do like other banks offer and send a low balance alert or something e-mail or text. they told me they don't have the technology to do that yet. WTF?

    AGAIN!!!!! ANOTHER $35 I was told because the item "posted" on the 14th but the direct deposit didn't "post" until the 15th therefore it creating a overdraft. But... if you look at the screen they posted less than 24 hours and should not have created a overdraft. They said (bless their hearts) they were sorry BUT they were unable to refund the $35. OMG...I REALLY, REALLY, REALLY HATE (a strong word) that company!!!!!!!!!!!! I have never felt this way about one company before in my life! I have given this company so much of my money! AAARRRGGGHHHHHHHHHHHHHHHH!!!!!!!!!!!!!! WTH!

    BOA are the biggest ass wipes there are. $425.00 in overdraft fees. Yes I did (as others) make a mistake that i had one big bill that i miss changing to the correct date. Then BAM.. and they don;t even let you know. I will be fighting this losing battle for the next few weeks. But what can we do. they got us by the balls and all the banks work the same way. The american banking way screw thier customers!!!!

    I just got hit with 420 dollars in over draft fees this past 2 days... I am totally done with this bank. Funny how they choose to charge the fees first before the post your deposits. Keep up the good work, great website....

    I am one of the people who have been laid off... I am working really hard to keep my credit up to par so I set up a online bill pay with a company on 6/12 for the payment to come out of my account on 6/17 when my unemployment check is deposited. Well to my surprise the payment came out on 6/12 during the weekend. Now I knew what my balance was yes, I check on a daily basis b/c of my experience with BOA and I stayed within my budget. The payment came out and cause a ripple effect of overdrafts. I was told by a customer service rep that if I'm lucky the purchases would come out first and then I would only have to pay the $35 for the online payment. Well needless to say it didn't go like that the online payment went through first thereby causing a BIG mess. Funny though the purchases where made before the online payment. Go figure?! I went to the office, since I am only receiving unemployment and trust me it's a far cry from my old salary but I make it work. I cried and begged (I am NOT the crying type) to manager from the Lake Creek Parkway office in Austin TX handed me a tissue asked what type of car I drove since my payments seemed high to him... And I shouldn't be so hard on myself. Excuse me?! And told me he couldn't help me. He looked at the account and agreed that if the "payment" hadn't gone through before the date I requested my account would have been in great shape. So with that said $350 in fees were applied.

    I rushed home crushed that I had NO money since the bank fees had eaten it all up and called the customer service # I spoke with a manager and she "gave" me $125 of the fees back but refused to give them all back and suggested that I contact the other company and file a fraud complaint.

    BTW... I am a person that when I go over my balance I will take the penalty and will not call them for my mistake but when the mistake is obvious I would have thought they would work with me. Especially since I had 4 accts when I was working and had money going to each of the faithfully every payday. I have since closed all accounts except one since the direct deposit goes there, but as soon as I return to work it WILL be closed.

    I am taking my business to CHASE and they are giving me $150 for opening a account!

    The destruction to the millions of lives of the families evicted from their homes without recourse is not enough for Bank of America. Our national economy in ruins while Ken Lewis of Bank of America and the board of Directors got bonuses paid to them after receiving Taxpayer bailout funds in excess of 45 Billion dollars is not enough of an insult to us the American Taxpayer. To and insult to injury, Bank of America now needs more than another 33 billion dollars from us to keep their doors open as the economy gets worse. Where is the Bailout money for the poor and the fireman as well as police officers being kicked out of their homes??

    Laying off more than 35,000.00 Bank of America employees so the fat cat Bank of America top executives could ensure their jobs and get more bonuses is not enough for Bank of America to get away with. No, they have to send out their Bank of America P.R. agents and bank employees to blog sites so they can talk about how great Bank of America is and it makes want to up chuck.

    Bank of America screwed me over on my credit card rates and doubled them with no notice in spite of my perfect record with them and top credit score.     I used their online banking. A pending transaction disappeared through their intricate system of tubes and wires, causing my balance to appear to be 40 dollars more than it was. I had five transactions just over 40 dollars. The pending transaction reappeared, the 40 dollars was taken, and then the five transactions caused me to go negative. Every time I've overdrafted has been because of their online banking. The customer service guy said online banking is a helpful tool, not the be all end all. I said then why do I get notices and emails saying go green, start paperless banking if it's just a tool and he didn't know what to say to that. I'm now getting notices that if I don't pay what I owe then other banks won't want my money. I've opened an account at two other institutions that don't charge monthly maintenance fees, and don't charge by the overdraft transaction, but by the day. I know I'm not the only one with issues with BofA, but it's getting ridiculous with what they are doing.

    Oh, also, I heard that if you call their Customer Care Center that it costs them at least $1.00 per call. I don't know if that's true or not, but if this doesn't get settled or at least out in the media, I'm going to be giving them quite a few calls!!!!!!!!!!!!

    I accidentally routed a credit card to be paid out of my account when it should have been paid out of my husband's account, both with BOA.

    Yes, it was my accident. I have no problem paying $35.00 fee, just the first one.

    Unfortunately, we didn't figure this out until later, but I charged 5 more items at various stores, and $35.00 was added each time. I contacted BOA in online chat. I have the current transcript of the chat session which took a few hours.

    Here are a few excerpts:
    I asked them, "Why didn't you deny my card?" I said, "If you did, I would have paid the $35.00 but would then have known to go back and check my account."

    BOA's answer (a script): "The reason we may authorize a transaction while there are insufficient funds is because we understand that it might be frustrating for our customers when they go to a store and there are transactions are rejected."

    (((See, they're just thinking about us **cough** **cough**)))

    I said, "I'd rather deal with the frustration and humiliation rather than pay $175.00.

    I said, "You say that the reason you ***may*** authorize a transaction while there are insufficient funds . . .? I asked, "What drives your decision?"

    BOA said, "That is based on your relationship with us."

    So, I said, "So I get to pay $175 because we have such a great relationship?"

    Unbelievable!!!!!!!!!! They were unable to refund the fees because they were "assessed correctly". Yes, correctly according to a questionable rule they were following. Ugh.

    I did get $89 back for being a long-standing customer (we have our mortgage with them (unfortunately)).

    Now, though, it's the principle of the matter.

    I was $1.75 short. Called and told them I was putting $3,000 in the account. They went ahead and charged me 3 x $35.00. They are the most insensitive crooks. What am I doing? Switching to a different bank. BOA does not give a shit, they have all the bailout money and a licence to steal and beat the shit out of the public.

    I'm so fired up right now. Today I went to deposit my paycheck and was told BOA was putting a hold on my paycheck until 7/21/2009. There is no reason for them to do this. My account was not negative and the company I work for is local, but they bank with a different bank, which is also local. When I was leaving the bank I heard them tell someone else that there was a hold on their check. WTF is up with this. It seems to me that they're putting holds on accounts in the hopes of people bouncing checks and then they can make a quick $35+ in overdraft fees. Something needs to be done about this. I'm calling my states Attorney General, the FTC, and contacting my state senators Monday. It's too bad there's not a way for a large group of people to make complaints all at once about BOA and start getting some changes made.

    I've also been charged over a $150 in overdraft fees. It's been a few years since this happened to me, but when it did, BOA posted in order of the amount and not the order the charges were presented, which made me bounce more than one check, which put more money in their greedy pockets.

    I will definitely be saying bye-bye to BOA in the next couple of weeks and saying hello to American Eagle Credit Union.

    Thanks for writing this. I had a similar 'problem' last week. Sure, I made the original mistake, but why did Bank of America CONTINUE TO AUTHORIZE CHARGES to my debit card?! I'll tell you why: so they could charge me 6 times instead of just once.

    I went into a branch office to discuss the matter with them. They treated me like a child. So, I closed my CD and will be closing my checking and savings accounts as soon as I switch my direct deposit to another bank or credit union.

    I've trusted Bank of America with my money for over ten years. I trusted them to PROTECT my money, not wait for me to make a mistake that they can capitalize on.

    Two years ago, they made me their "MVP"...as a promotion...this year they are canceling cards, raising fee's, and ya know why? BECAUSE THEY RAN THEIR BUSINESS INTO THE GROUND AND NOW WE ALL HAVE TO PAY FOR IT! HOWEVER THEY ARE STILL GETTING THE MILLIONS IN BONUS MONEY......ISN'T A BONUS SUPPOSED TO BE FOR DOING A GOOD JOB? NOT IN THE BANKING INDUSTRY....I GUESS THE CRAPPIER JOB YOU DO, THE MORE MONEY YOU MAKE...KINDA LIKE OUR POLITICIANS IN WASHINGTON....BETWEEN THE BANKS, AND OBAMA...WE WORKING MIDDLE CLASS PEOPLE DON'T STAND A CHANCE.

Try to call customer service - you'll eventually (after 15 minutes of pushing phone buttons)find yourself speaking to someone in India who reads from a script, has a poor command of the English language and doesn't give a rodent's behind about you.     There was a class action lawsuit filed against BOA earlier this year for rearranging the posting order of transactions and charging fees. I actually caught the fuckers taking transactions that had cleared and putting them back into the pending column after my balance got down to an amount where it would put my account into overdraft status so they could rape me for more fees.

    I know how you feel BofA did the same thing to me last week, i could not believe it, i went down to their branch bitched their ass out and they would not reverse the charges, i closed my damn account with them that day leaving the so called balance i owed them, cancel everyone of my direct deposits so they could not get what they wanted out of me. I'll start using the check cashing places if i must, but i will not go back to BofA again! :0( We are broke enough as it is to begin with and they have the balls to take MORE from us cash starved people??? They've got their f-cking nerve.

    I got screwd over for the second time today. I got on my hands and knees and actually begged. Im a 23 year old man begging! on his knees in the bank!. They removed one fee and that was it. I owe them $200 because they held my payroll check. Im joining a credit union and im hoping these bastards go down in flames.

    Well whatever you do ...dont go from BOA to Capitol One cause they are just as bad ..and their saying of .."what's in YOUR wallet ?" their freakin dirty hands are thats what !! I am on a fixed income and dont always have transportation and when I had an overdraft I couldnt take care of the bill because I live 32 miles from the bank and no transportation was available .. I called to let them know that I would take care of the overdraft in three days ..guess what !?! that didnt mean crap to them I got hit with three more overdraft fees all because of a $1.50 mistake and then they nailed me with a delinquent balance fee for every day I was at a negative. The banks are ripoff artists and now the government has given them all that bailout money when if they had just given each citizen 10 K each it would have been cheaper and I guarantee you that 90% of the recipients would have paid off a great deal of their debts and the banks wouldnt have had to be bailed out.

    I used to work for BOA. Didn't know how bad it was as an employee til I left to work for another bank. I am a little on the fence with all of this. Robby, YOU I understand. As well I do all of the people who get charged mulitple 35 dollar fees for small overdrafts; it happened to me as well. However, there are several people on your site that just do not seem to understand that a DEBIT card is just a convenient method for you to basically write a CHECK...it no more checks your checking account balance than your paper check does when you stand there and write it. It's not magically keeping track for YOU what you should be keeping track of yourself. Again, not chastising, but I don't really understand how people keep saying things like, "it LET me use it and didn't block the transaction..." LISTEN UP! A Debit card does NOT work like a credit card! Please understand this. Now as for the ridiculous fees, the purposeful strategic posting of balances, the holding of perfectly legitimate deposits, I believe ALL of it. Are the crooks? Yes. Are they preying on our irresponsible spending habits? Yes. How do you get it to stop? Stop allowing it. Stop doing stupid things financially, pay attention to your available account balances, stop expecting your bank to babysit for you, AND if you do all of these things and ONCE in a GREAT WHILE make a mistake, be doing your business with a company that is small enough to have local decision making capabilities that can forgive you and waive fees. But I stress...don't push your luck. Be responsible. You can't keep crying wolf. No one will listen. I can say these things cause I'm not perfect either...and one thing is for sure...having to pay a huge penalty for 30 dollars in overdrafts spread over 7 tiny little debit transactions made me a MUCH MORE AWARE ACCOUNT MANAGER of my own accounts. Didn't make the mistake again.

    Amen.I have lived through this also. Recently they canceled one of my credit cards,because I was deemed a "High Risk" by one of their assessment analyst. Why I have no idea. I have been a customer for 12 years,make 6 figures,and have always paid my bills on time.
    I canceled my account,and went to a credit union. Best move I ever made in my life. They also acquired my mortgage company recently. (Country Wide). I am in the process now of refinancing with another lender. I hope they go under.F BOA.

    I hate Bank of America. They have treated me like crap for years. Now they have those commercials running about how they've changed.
    I deposited a check once where the amount was handwritten "Five Hundred dollars and 00 cents", but the amount was accidentally written as "$5.00". I hadn't noticed! You would think the hand-written amount would be correct; the check was supposed to be for $500. After that, they never never cash another check of mine, and I am an account holder. When my income was decreased recently, I went to them to try to get help. They said something about my 'negative history with them'. I Hate Bank of America. I have left that bank many times in tears. They acted as if I was nothing to them. I hate Bank of AMerica!!

    My BOA story - I used one of those checks from my BOA card, then found that they couldn't/wouldn't allow me to set up a recurring monthly payment from a credit union account. I would have to remember to go into my account every month and make the payment. I wasn't happy with that answer, so I paid the account in full plus a little extra (I wasn't sure what the interest would be so I just rounded up). On my next statement it had a $26.96 credit, so I requested that they refund it. After a few weeks I got a check. Then I got a statement with a balance due of $11.02. I assumed (my mistake!) that they crossed in the mail, so I ignored it. The next month I got the same statement, so to be on the safe side I paid it. Then I got a statement for $1.50 which is the minimum monthly interest charge! I freaked and called BOA and had to argue with customer service, then request a manager. I finally got them to remove the $1.50 charge. The manager told me "we shouldn't have refunded the money since we hadn't settled your balance" - but they sure we happy to charge me a minimum interest fee for their mistake! I have had this card for a long time and don't use it so I won't close it but I will NEVER use it again!

    BOA makes money, no doubt, but you have to ask, 'how can they do this?' The answer Robby is that YOU SIGNED UP FOR IT. Go read your agreements, you signed them, perhaps you should read what you sign in the future. As you are finding out it can be quite costly not to do so.

    No I do not work for BOA, thank goodness.

    FYI, they can block your credit if you don't pay up. That is very bad news, trust me. Don't think that they can? Go read your BOA agreements.

    Yeah they try to give you every excuse in the book on to why it is your fault and they don't want to rebate the fees. The best thing about it is they actually train their employees to do this. They train their employees to lie to the customers and make them believe it is their fault and they are stupid and can't do simple math. I know this because I am a former employee whom has been screwed just like the rest of you. They have this new thing in the online banking section where you can look at your actual balance and then a balance with authorization holds which is pretty dumb cause basically they r taking the money from you twice only to put it back and then say OH YOU WENT OVER and charge you the fee. You as an employee actually get in trouble and can even loose your job if you give fees back I know in my area it was unacceptable to give fees back it didn't matter what the situation was. If you noticed they went from BANK OF AMERICA HIGHER STANDARDS to BANK OF OPPORTUNITY that really stands for we will screw you every opportunity we get. The real sad part of all this is that I actually stood by these JACK ASSES and bought into this crap!! Shame on me!! Again I am a FORMER EMPLOYEE

    HELL YES! I went for a BoA account as a freshman in college. I didn't know they could do that! The worst part that is that's not uncommon for banks with much higher fees and whatnot to set up shop. First Convenience Bank comes to mind (the banks you see in your local Walmart - or mine, anyway). They charge $3.00 per ATM withdrawal and you can only take out $200 per transaction. So if you need $500, you have to spend $9 of your own money to get it!

    On the upside, it's good to see people getting our BoA stories out in the open. I think a lot of people are embarrassed when things like this happen to us, especially with the holier-than-thou attitudes you can get. To those people, all I say is: may your bank account get one of those dreaded "verification" charges. :) heck, I just overdrew my account for the first time EVER; thank goodness it's with a credit union and I have (free!) overdraft protection. Maybe the check will get there in time, but my point is that PEOPLE MAKE MISTAKES. Why BoA and other banks think we should pay out the ass for it is beyond me.

    Same thing happened to my college student daughter. She kept using her debit card for small purchases of $5 or less, thinking her deposit had already gone through, but instead ended up with hundreds of dollars in late fees. She'd put more in and the late fees just kept sucking it up. We have 3 houses financed at BOA, 3 checking accts, and a savings acct. I went in one day to get someone to notorize a paper for me. Wouldn't do it, wasn't bank business! I went across the street to a credit union, where I had financed a car once. Didn't know anyone in there and they bent over backwards to get everything done for me. I'd love to move my accts, but that would mean refinancing, which would be a bit expensive if anyone would even do it?

    We dont have B of A in Indiana, but as a native of California, I am familiar with them. Bank fees suck, I had to pay one once 2 years ago. I guess if you are living that close to the edge, you need to leave a 5 dollar cushion. I assume most of you are adults and read the fine print, you overdraw, you pay. I really dont think you should blame either Redbox or the bank for this. You are at fault for not knowing how much you have in your acct. If the bank waives the fees this time, I hope you man up and pay them the next time this occurs. (no I dont work in the financial industry either.)

    I had 2 credit card accounts and home mortgage get sold to BOA. Before this I never had a late fee, never had any difficulty. All of a sudden, things started to fall apart. $50 late fees, forcing me to go to brances and hand deliver payments. Best one of all, a service charge to make an electronic payment. Every other bank in the world encourages efts to make it easier for everyone. There is a special place in hell for all of these creeps, esp the ones who sit in their cubicles and strategize how to extract every last dime from every one of us. Annd we need to bail them out? What a joke

    I was in Bangkok last year when my Bank of America ATM card was blocked for "security breaches" in the US that did not involve any retailer I had used. It was a system failure. Great. I am stuck in Bangkok with no cash. I call B of A and ask them to send me a new card by Fedex. I call FOUR TIMES to ensure this is done. Card never arrives. Fedex in Bangkok says B of A have sent nothing. I have my girl to help out, so it's not a total disaster. But when I get back to New York I find the card mailed to my home address. Brilliant. I call them and they say "It's not our policy to send ATM cards abroad."

    This is a Mickey Mouse bank that has lost billions through incompetence, arrogance and amateur stupidity and we the tax payers have just bailed them out to the tune of billions. What a fucking joke. At my hotel in Bangkok they asked me if I was with Bank of America. The Asians all shook their heads sadly when I said yes. "We've had so many complaints from people," they said. "It's the worst bank in the world" Amen.

    Bank of America screwed me to by posting debits that where and would have been cover if they had don them first. My SS can and the debit can in all on the same day pending. they put thru the largest debit firts then the rest of the debits in descending order with my SS depostite going the NEXT day. How very convienent.

    I overdrew my account a few months ago. My mistake and I paid for it to the tune of $105.00. (3 overdraft fees of $35 each) I am a daycare provider and get checks from 8 different families each week. Due to my hours, I usually do all banking in my banks ATM. One day I noticed the bank withdrew the amount of my deposit and then credited me with a lesser amount (approx. $180 short) I promptly went to the bank and spoke with a manager. Guess what this jerk off told me!? "You seem to be pretty upset over this, I have some suckers behind the counter if that would help.". Are you kidding me? Where does he get off talking to a customer like that? Yes, I was upset. The bank was trying to screw me out of my hard earned money! In the end, I ended up doing all of the research, giving the bank the account numbers and banks of all of the checks I deposited. The deposit ended up being 3 checks short, of which I figured out which checks were missing and basically gave them all of the needed information. I didn't get one phone call of apology, no letter, nothing! They never admitted they did anything wrong. I complained, told them when the customer makes mistakes we sure as hell pay for it and I wanted those three $35 fees that i paid earlier for MY MISTAKE to be refunded. They eventually did but they made sure to tell me it was a one time thing and in the future would only refund NSF fees if it was the banks error. By the way, this was US Bank.

    my daughter has the same thing going on now...$35 overdraft charge every 5 days...because bank of america allowed money that was not in her account to be withdrawn...they issue credit cards to teenagers and open bank accounts for them not fully explaining the consequences...normally, i would teach my daughter a lesson and tell her she needs to pay and keep up her own money and spending in balance and in check, but i now know that it's the banks that are screwed...and now it's time to screw the banks back...charge as much as you want...never gonna pay!

    Advertise it. Almost anyone who has had any relationship with BOA has a similar story. They are using our money to do business yet if and when we make a mistake there is no grace period or consideration. People make mistakes. We are human. I recently got 8 OD fees of $35. I had deposited into the wrong account. As soon as I realized it I went to the bank deposited another large amount into the other account and spoke to a bank manager. i was told to call custumer service in the morning. The guy was a jerk. I have had an account with BOA since I was a kid while they went through every name change in the world. Now i am waiting for my Credit Union checks and on Tuesday next week I am going to go and close the three accounts I have at BOA and the other 4 accounts my kids have. They are a disgrace to an American Business entitiy.

    Hi Robby, I can do you one better! IRS notified me that my stimulus check would be deposited in our account on May 2nd 2008, it didn't show up until I contacted IRS, it finally showed up on June 21st 2008. I thought it was all done but nooooo! On April 21st 2009 Bank of America took our $1200.00 out of our account without notifing us and sent it back to IRS, it appears that IRS sent another $1200.00 on our behalf but they deposited in somebody elses account. So it was so much easier for them, they sent our money back instead of trying to locate the wrongfully deposited money. It took better that 2 months to get it corrected, (not by BofA but by the IRS) which they sent me another check which I deposited into our new account at Chase Bank.

    Well guys, I found about about the fine print with BOA. When my business dropped off about 80% and no one was paying me what they owed because their business was in the same condition...almost no business for over six months, finally I wrote some business last month. Nice feeling but it didn't last long. Just a day in my account and BOA sucked out what I owed, about 3/4ths of my balance, right out of my business account. Now I can't even pay the minimums on my other bills. If that wasn't enough they lowered the credit limit so that my balances are all over the limit now. New fees, new rates, new penalties. Now I see why they are putting up bullet proof glass at the teller counter. When I asked at my local branch they said it was to protect us the consumers...no doubt!!

    I AGREE. A bunch of B.S. even my old Italian descendants didn't swindle money in this fashion. To me, this is like BOA being a legalized mobster organization. Years ago, if I remember correctly, if you had a debit or credit card you were only permitted to use what was available on your credit line or the balance in your checking account. For example, you have $10.00 in your checking and your purchase was $10.39, IT WAS DECLINED!!!! not paid as has happened to my son in his campus edge checking account for .05 cent overdraft ---- THE CHARGE SHOULD BE DECLINED...period if their is not enough cash to cover it...unless you have an overdraft account..isn't that what BOA wants you to have so they don't decline transactions. DO THEY DECLINE ANYTHING ANYMORE....maybe that's why we are in this MESS IN THE U.S.

    Dude thats nothing try this one. I had 107 dollars in my account after 10 pending charges should in my account ready to become full charges so I went to the store and bought food it came to 120 dollars no biggie I can take that small hit and the extra dough but to my surprise the next day they paid the grocery store and bounced 11 other charges instead so they pulled almost 400.00 in overdraft fee's plus the cost of each over draft item.

    I have been a BOA customer for over 10 yrs. Never an issue, hiccup, not even a hold on a deposit. Last week I had an overdraft of 14 bucks. Yep...a whole 14bucks. To date, I have been charged nearly 600 dollars, 35 bucks at a time. I explained to the mngr. and everyone else who would listen (and many that didn't want to) that if you were earning $600 from $14 it is difficult to understand why you needed to take billions of taxpayers dollars to stay afloat. Thank you BOA for your compassion for the working man. It is my intentions to maintain my savings in a box.

    I was thrilled when I found this site ... I could kiss each and every one of you for expressing the same vile feelings that I have for BOA. So far I haven't had a problem with their overdraft fees, but I have been hit with an increase in the interest rate on my charge account with them. It was 11.99% in Oct and jumped to 24.99% in Nov. Naturally I called them thinking it was a mistake since I have never been late, was well under the card limit, and there was no apparent reason for the increase. I was not very politely told that they basically could increase my rate as much as they wanted, and if I wasn't happy I should just pay off the account in full. Nice, huh!! I have inherited BOA. This is my 3rd or 4th bank change because of mergers. To make matters even worse, they are now holding my mortgage due to another buyout. I call them low-life legal loan sharks!!
    By the way, our president is well aware of the situation, but has decided to give the "poor" banks the opportunity to recoup some of their losses. So now that they have our TARP money, they have been allowed to rape us as well. We're all being sold down the river.

    back in the day, banks paid YOU to use YOUR money, those days are long past. Interest rates are pitiful. Checks deposited into the banks are cleared right away, well at least for the bank, you still have a waiting game. You can thank the lobbyist and gov for allowing banks to screw you.
    You are right, your card was swiped once--that is one transaction no matter how you look at it. I think I would go after the video store also.
    For those of you naysayers-- get a grip on reality-- we all pay for our mistakes, but when your getting screwed, you need to fight back.
    BTW - I have never and will never deal with BofA, my mortgage was with countrywide and BofA bought them, I quickly refinanced.

  • Blame yourself people, we have online,statements and phone service to know what you have in your acct!! also check registry's so pretty much people have to be responsible for your own acct. Everyone knows that bank chrges a fee for overdrafting the acct, So keep better tab of your acct so the bank wont rape your sore ass!! your fault deal with the fees and pay them!! stop bitchin about your mistake!!

    it is too bad i just went throught the same thing and it was with boa. i have a morgage 2 checkings and a savings with them, at first i deposited a check into my regular checkin the bank teller put it into the myaccess checking witch is never used for deposits always withdrawls i even gave her the debit card of the regular checking, no i didnt check the deposit slip because i have never deposited anything into any of my other accts. well i went and paid 5 bills and because when i called in about the issue they put it as resolved when it wasnt resolved i told customer service i was going into the banking center near me, the manager stated that since they already listed a solution that there was nuthing she was going to do. now my morgage is also with boa and it was due no later then the 1st, so because i paid 175.00 in fees i was at a balance of only 500.00 but i went and pulled 700.00 out, i made purchases 2 days before this and i was thinking well i have to pay my morgage so i guess i will just have to pay another 35 fee, wrong they listed the atm withdrawl before the purcheses made 2 days prior and charged me another 105.00 in fees, so after i tried to get them to credit it back and failed i closed all accts except for the one that is in the negatives because of this issue and as soon as that gets caught up it will be closed also. and to tell you the truth if i was able to refinance i would just to spite them, so good luck and i appreciate everything you are doing

    I had a bad exsperience a few months ago, I get my disibility on or before the 2nd wednesday of every month, I checked my bank account on Tuesday evening around 8pm, my disibility went through, so I went to the store and got some groceries at safeway, the next day, I checked my account and noticed I had a overdraft twice, one for 1 dollar and one for 26 dollars from safeway...I thought that was weird so I called the bank of america 1 800 number, they said that even though it showed that my automatic disibility deposit showed up on Tuesday evening, it really isnt in there...I said, "that does not make sinse!" I said I made a copy of it showing it is there on Tuesday...they told me that the "on line" banking is really kinda of missleading and not go by that, and that the disibility deposit was put in there on Tuesday, but it doesnt reflict tell Wednesday...I actually fought them for a month and finally got both my overdrafts back...I actually had to go to my bank where I signed up with Bank of American...I since then transferred my account to another account and closed my Bank of American account..basically they told me that the "on line banking is missleading to there customers!" Now, what does that tell you!!!!!!

    Bank of America sucks!!! REALLY, TRULY SUCKS!! I had the same issue, but I was overdawn ONLY $0.75 75 CENTS!!! Come on, that is ridiculous. I made a payment for a bill and had the EXACT amount to pay with about a dollar left. Well, I had no idea the company charges 1.75 to do the transaction and I could not understand WHY BOA authorized this seeing as there would have been $0.75 overdraft. Of course I was charged $35.00 overdraft fee for being 75 CENTS OVER THE LIMIT!!! This is insane to me. I tried arguing the issue and got NO WHERE with their representatives NOR the supervisor. I was told it was their policy and that was that! They truly suck big time just a bunch of low life losers and big time A$$HOLES!!!

    So why don't we close our accounts and move to credit unions and other smaller banks that are customer-friendly? I've banked with BOA since it was NCNB in 1980 and they stuck it to me a couple of times using the same tactics. I threatened to move my business and each time I got a courtesy removal of the fees. But, I've had enough of BOA and I will move my accounts to Truliant Credit Union by the end of August. There were times when banks were viewed as reputable institutions, the pillars of the community. Now, they are worst than lawyers!

    Oh my goodness! Bank of America is a big crimimal organization. They got me so many times for the same thing I finally had to break down and close my accounts. Between the overdraft fees and them putting holds on deposits more than $500 Bank of America caused me to be late on bills and had to borrow to buy food for a week. And they didn't care when I called complained over and over! I am actually finished with banks and have moved over to a credit union. If there is another class action suit against Bank of America count me in!

  • Well I had the same problems with BOA. I changed banks, then I ran up the negative balance to over $2K by constantly using my card for online purchases. No there wasn't any money in there, but it didn't stop amazon from charging a dollar to the account each time, and every time they did...bing another fee.

    So after all of this i call the customer service center say " Yes Jill (the name of the rep) my account seems to be a bit off, could you tell me why i am negative ?" LMAO at this point but not to her. She replies "Well there seem to be a few NSF charges here... lets see. According to our records, you owe $2070.00 in NSF fees, plus a negative balance of 167.00 which all seems to be from Amazon.com"

    By now i am in tears from biting my lip trying not to laugh. "Well, that's not good" I replied. "Well we can take care of this today with a simple credit card payment, which card would you like to use...?" to which I replied, "Weeeelll, I was kind of hoping that you could just give me a loan for that plus another $10,000.00 or so." Her response was" .......... we really should take care of this balance first then we will transfer you to another person to fill out the loan application." My reply " Well then if you cant help me... just close my account" her response " well sir we cant do that until you have paid all outstanding fees." my reply "According to my attorney, you cant do that. I am telling you to close the account, all new charges to this account from this date forward will be considered fraud and I will seek to prosecute anyone who posts charges to the account." ............

    I got a letter in the mail 6 days later. The account was closed please enclose a check or cc# for the amount due ...$2237.00 ... they get nothing. Assholes.

    I have had numerous scew jobs from bank of America...they bought out other company's account and tripled my interest rate on 4....my payment on one alone went from $300 to $550 a month...i even had a closed account from Nations bank , which i had closed 6 years ago with the understanding that i would pay it off at the rate I had, (choice had been accept a higher rate or close and pay off at the low rate)that BNK O Am bout it and raised the interest....i believe that to be illegal...i have filed complaints with the BBB, and they keep coming back with , BNK of am, says they are right and willl do nothing..Their customer service people are rude, nasty, and do NOT care if they help at all.... IF everyone files with BBB, Bank of America will get lots of negatives on their BBB reports and they will also have to address each issue which, maybe will aggrivate them enough to DEAL with their customers in a fair way...IF NOT, we can keep aggrivating them....please.do this

    Yes, BofA screwed me too. Some company caused an overdraft fee to my account through direct withdrawal. Did BofA DENY the withdrawal? NO! Instead they chose to fine ME, TWICE! I was told that if I put that money in by 3:00 that day I would not be fined for overdrawn fees. OK. At 1:30 the money was in my account and available. Since my bank is in California and is 3 hours behind me, 1:30 means it was 10:30 AM at my bank when the money went in. I was still charged $70.00. Screw Bank of America. I still have that bank, but I am soon going to transfer all of my banking business elsewhere. They don't treat their rich customers like that, but the ones that aren't rich get nabbed by the short hairs everytime. Seriously, is it fair that they can charge someone $35.00 for a $5.00 overdraft? The punishment doesn't fit the crime.

  • Good effort here. One caveat, though: I cannot imagine having a bank account of any kind with less than $5 in it. How did you manage that? Most banks would have eaten that up by creating some kind of charges against the account.
    I also have an on going feud with banks that have the balls to charge me for getting my own money, out of my own account, from a damn machine. There is such a thing as being so greedy that the populace hates you with unending enmity (See Oil Companies for proof).

    I have 2 boys that are in college, so I rented them an apartment. We got Direct TV services 3 years ago. In January, we decided to upgrade to a DVR box in their living room. After 3 lame excuses of arranging someone to be home to install the box and $20.00 cash (at the installers request) it was installed, but not correctly. It never worked. My boys mentioned to me that it did not work. I called DirecTV and reported. Several months later, still NOT WORKING.... I told DirecTV, when I get my services, I will pay my bill. This went on for a couple of months and still NOT WORKING.....
    I went to depodit money into my BANK OF AMERICA account and realized, I had a negative balance. I quickly investigated, and found out that DirecTV took out of my account (from my debit card, the last methed of payment, from online) $892.33........ WITHOUT MY AUTHERIZATION.... I called Bank of America to have this payment stopped, because it was pending at the time and it was funny to me how the bank new more about my DirecTV account than I did. They told me that they could not stop payment on a debit transaction. Once it went through, they would disbute this transaction on my behalf, But it would be better for me to work it out with direcTV myself and turn in my equipment (how bizarre). DirecTv charged me $400.00 for early cancellation fee, $343.00 for equipment and the rest of it was for services that I did not recieve.
    From this, I was trying to get money from everywhere I could to cover this loss. I ended up having 3 NSF charges of $35.00 each. In the meantime I had gotten DirecTV to reinstate services and send someone out to investigate my boys DirecTV services and the IN HOUSE (DirecTV) technician said that it was not installed correctly and needs to have the second wire ran and in order for it to operate correctly, in order for him to run the second wire, he had to have written permission from the apartment owner in order to do this. So, It is still not working to its full patencial.. DirecTV did recognized there wrongness and is supposed to be refunding me $400.00 (cancellation fee) and $343.00 (for equipment) but, I have not recieved it yet. Could take 30 days. How funny, It didn't take 30 days to get it out.....Why so long to put it back in?
    Getting back to the rip off Bank Of America, who lets anyone take from your account WITHOUT permission...... Told me that with the economy, they are not refunding any NSF fees, unless it is a bank error.. Luckily the FUCKERS only got $105.00, I'm currently waiting for my money from DirecTV to be put back into my account and I'm closeing all my accounts at BANK OF AMERICA... BE AWARE, DO NOT DO BUSNESS WITH THIS BANK... All They Want Is Your Hard Earned DOLLARS... How Sad...
    And yes, It seems to me, Bank Of America are sceaming with different companies (like DirecTV) to FUCK YOU OVER!!!!!! Both of these companies DISGUST ME....

    Does anyone know how to email the president? I have had tons of problems also with boa and i hate them. Years of being a good customer means nothing to them. I may as well have been a late paying customer, which I'm not.OUR money is what the president gave them for a bail out and now they're screwing US! I just wonder if Obama knows all this. Maybe if everyone started emailing HIM (boa doesn't care) he'd start listening!

    I was first screwed by BofA when I was in college in the late 70's and have spent my life telling people to stay away from BofA! When I got married, I was able to join Desert Schools Credit Union in Phoenix, AZ. Since then, they have opened up their membership to the general public. CREDIT UNIONS ARE THE WAY TO GO !!! TELL THE BANKS TO SHOVE IT !!

    I recently over drafted from my checking but had more than enough in my savings to cover it. The total overdraft was about 100$ but fucking BOA took out the money in 20$ increments and then charge a 10$ transfer fee to click a button and MOVE MY MONEY FROM ONE ACCOUNT TO ANOTHER...ELECTRONICALLY!

    I have a business credit card with B of A, I have never been late with my payments, pay way over the minimum payment due every month. As with a common practice going on, banks are suddenly cutting down the limits, sometimes to the amount you owe, causing you to be maxed on the card resulting in lowering your credit score causing a domino effect across the board! So what B of A did was raised my interest rate from 12.99 % to 24.99%! Saying I was carrying too much revolving debt! Even though I pay my bills on time! This resulted in huge interest per month! Now I have to try like hell to come up with the cash, pulling it from my business by laying off 1-2 employees, scaling back my operations due to lack of cash flow to pay this shit off and tell B of A to kiss my ass! I am closing my savings & checking acct. today after getting nowhere with customer service! Bank of America SUCKS!!!! I am staying with my Credit Union as they have never did anything like this!

    Don't use Compass Bank as an alternate, either. Someone who works with us tried to cash her company paycheck, which was written on a Compass Bank account. They said they would let it go this time, but in the future there would be a $10 charge for cashing their own customer's check, because the employee didn't also have an account there. In the first place, no one should be hassled over cashing their paycheck, especially when the check is issued on that very bank. Compass offers a free checking account if you have auto deposit, the better to fuo and make a profit over these abuses. An account holder has the right to deposit their check and have it credited to their account without a hold immediately...so now I guess they hold deposits until it is convenient to credit them? In any event, I did a puter search on Compass and boyhowdy to they have an awful reputation as well. We learned our lession with Bofu way back in 1977, and have steered clear of them ever since. Now, however, our mortgage has been transferred to them and I'm scared. They will mess with us soon. Meanwhile, a "manager" at Wells Fargo refused my deposit without a 5 day hold, because she loudly proclaimed over the drive-thru that we didn't have enough $ in our account to cover it in case it "bounced". This was a secured account check I had written from for deposit that was a five-figure amount, which I have done several times over the last two years to fund my bill-paying account, which pays no interest. I have deposited over six-figure amount in this way over the last year. Needless to say, at another bank, a manager checked our "relationship" information, saw the notation that this account has a history longer than some of these smartypants employees have been alive, and I received an apology and immediate credit to my account. However, the first manager would have been equally rigid about refunding whoknowshowmany $35 fees if the deposit were held and my bill pay transactions were debited first. It would be nice to know if customer service conversations were really recorded, as the menus say, because this could be helpful. Unfortunately, when you complain about rude and apathetic responses to real issues, the first thing they want to know is the person you spoke with, and they are never rounded up and fired like they should be. I was disappointed to learn the policies of the credit union we have, as I would have opened an account there. They have subscribed to the abuse list as well, and I decided it was hopeless.

    What pisses me off is that Bank of America isn't even staffed with Americans - I know besides the point. My husband forgot his ATM card in one of the machines. I went back to retrieve it and was told it was destroyed. Asked why they didn't call me and they said they claimed they did. No messages on my phone machine I told them and they looked up my account. Now mind you the bank is in my own town, my address is on the account, at least 7 years ago the entire area we live in got an area code changed - when they looked up my account it still had the old area code of 201 instead of 973. They claim I should have called them when my phone number changed. MY NUMBER DID NOT CHANGE - the area code did and told them that if this was the case - they didn't notify me when their number changed either. Made them look at my address and realize that we are in the same town, a normal human being would have realized the area code change based on when the account was taken out like 19 years ago! The bank manager still contended that I should have called and told them to change my area code. They are hiring people with limited intelligence and NO common sense!

    I have a bank of america credit card that I paid off and (at least thought I had) cancelled a long time ago. I started getting statements from them again and called them to ask them why I was getting statements if the account was cancelled. The guy on the phone apologized and told me that he could see in my records where I cancelled it. He assured me that he would close it once and for all. I even had him send me a letter on BofA letterhead stating that it was cancelled. Not too long ago I started getting statements on that account again, and now, all of the sudden I have a $39.99 fee on the account.

    How the hell do I cancel this thing once and for all? (I'm in Missouri.) I want nothing to do with this company. All I want is to close this account that I WILL NEVER UNDER ANY CIRCUMSTANCES USE FOR ANYTHING (except apparently for paying fees). Obviously calling their customer service and trying to do it from that angle is worthless, no matter what they tell me. I'm pretty sure to legally sever ties I have to send a certified letter to someplace, but where?

    I had been wth BofA for 22 years through their changes. And I just left them, cause of paying out more money than the check I wrote. Then they starting bouncing everything. charges, charges, threir fault, Let me tell you I went and raised hell at the bank They were charging me $ 400. for their mistakes. So I took my money and went to BB&T, free checks, free checking, no atm fees, earn bonus rewards by using check card. I am very happy now that I left BofA the rip off bank.
    I talked with an e-employee, they have more work and they are laying off, not hiring to cover all the work, what a rip off.

    Hey go to www.helpwithmybank.gov to file complaints against these greedy bastards. My son is 17 and they pulled same shit he was ovrdrawwn 3 times total of 12 dollars and 3 35 dollar charges. I went to bank and was told if not paid they will go on his credit he is away at boot vamp and bitch at customer service would not freeze his account because of bank rules screw your customers whenever you can. I quir using these sobs years ago and stories like these make me remember why lol

    most banks are doing this i owned some realstate, i sold it and carried the note. i paid it off, i owed $60,000. the bank wells fargo, whom i had it financed with, when they did the paper work, they put names in wrong places and filed it at court house, they gave my property worth $110,000 to the person i sold it to. i tried to get my land back, it took 2 months , when i found someone to help me. they said onced it is filed it can not be undone. a lady that worked for them 16 years , said they did things like this to people because most people cannot aford to fight them , she said they have done alot of things to people that they were not susposed to do. i had to hire a lawyer it cost $750.00. the lady that worked for them. this is like the 3rd month. and they told the lady to leave it alone. that they had already settled it and it was final.the lady said she is a christain , and her contious was borthing her, about things she had to do that was wrong to people. she called me back and asked for my lawyers number. they kept giving my lawyer wrong numbers to call to settle this. the lady called my lawyer and told him it was wrong what they did, and that it could be fixed. the lady said she is going over all her bosses head and tell the boss over all her bosses things they were doing to people. her big boss called my lawyer and said fax him the paper work, i got my property back that same day.but the lady,s bank fired her, for going over her bosses head. i felt sorry for her. she said she would not be able to go to work at another bank, because they are doing things they should not do also ,and they think she might tell on them. Then on top of this i sold some property last week. they gave pay off as $600,00 over what it should have been. than charged me another months payment of $380.00, after they recieved payoff.they also went 6 months taking out only interest charges, because i was late a month so the next 6 months were all interest because i was late. they said they could do this if i was late on a payment, my bank now said wells fargo is famous for doing things they are not susposed to do to people , because they know they can get buy with it. If people do not get togeather and tell what the banks are doing to them it is going to go on and on. i wish we could get on Glen Beck show are Hannisy show , it might could help. channel 360 on news channel.maybe we should have tea parties also, they said it was a mistake about taking out to much money , but can not refund it becase it is already done, just like they told me on the last bad deal ihad with them.     Oh Yeah, I've had Bank of America take their share of my cash too!! This month alone they took 178.00, and 35.00 extra for extended time overdrawn! Seeing that I get paid once a month.. that came in handy for them. Also, they do rearrange things to get as many over drafts from you that they can! I have a friend that happens to be the manager at bank of america at a different location and she was quite aware what I was talking about!! It's something that they do on purpose, to make money off of you! Something has got to be done with this type of business practices!! So, don't think that when you happen to check your bank of america account online, it will look the same tomorrow... what cleared one day... will disappear and magically reappear when you think that everything has cleared, you use your card.. and then BAM!!! GOTCHA!!! I will catch them suckers changing my account around by printing a copy of my account each time I check it and then... I'm going to SUE!!!!

    Credit Unions are the way to go. They WANT our business and will do what it takes to keep us.

    Ironic that this should find its way to my computer screen today. Did you know that the lower your account balance the higher the banking fees are. Why BOA has decided to punish people with smaller bank accounts is beyond me and totally unacceptable. I am supposed to have no fees, but the last two prior months I got dinged 5.95 and this last month I got dinged 8.95. This is on top of some standard 5.00 fee that appeared out of nowhere. I am done! This bank was close to my home and they gave me a bank card with my favorite football team on it. They can stick it! Not worth it. I would rather drive farther to my old credit union (even with the high gas prices I will probably save more money).

    National City bank sucks also. I went into my account last night and there was plenty of money. I go into it today and I'm overdrawn and they have charged me $68 in overdraft fees. I check account 3 times a day so I can transfer money from savings account if I have to but somehow from last night at 1 a.m. until 9:30 a.m. today I owe them $68 in overdraft fees. How is this possible when there was only 3 items in the pending last night and there was plenty of money. I'm sure I'm not making sense because I'm SOOOO Flipping mad. I really feel like taking all of my money out of bank and hiding it in the yard and digging it up when I need it and using money orders to pay bills. The banks are F***ing theves.
  • My wife got hit so many times by the little pre printed letter of death that I canceled my accound with bank of america. She now only pays for stuff using cash or checks. at least these do not go through if the balance falls short. On the plus side she hasn't had to pay $39 for a cup of starbucks ot $42 for a lunch at mcdonalds in over a month.

  • Here's one of my stories about BOA. I work at a grocery store, do a little shopping when I finish my shift. I had 20 bucks in my pocket but decided to hold onto to it and use my debit card. I knew I had cash in the account. The next day I saw they hit me with the $35 fee. When I asked them at the bank why the debit transaction was allowed if I didn't have enough cash in there to cover it, I was told it was allowed as a service to me and if I got to the bank before the morning and deposited cash it all would have been alright? WTF? That's alright Bank of America... Paybacks a bitch!

    Bank of America was kind enough to authorize my sons Burger $5 Burger King purchase when he only had $3 in his account. They charged him the $35 overdraft fee and the another 5 more $35 fees for having a negative balance. Imagine spending $200 just for a Whopper. Hopefully one day when he has his own business and needs to choose a bank he will remember the way Bank of America treated him.

    I recently received another bill for my credit card account that I closed several months ago. I closed the credit card acct. because BAC raised the rate on my credit card.
    I also closed savings and checking accts. that were 15 years old, because I was charged monthly fees on savings and checking. I also have a MORTGAGE with BAC. I was suppose to get free checking, that did not happen.
    I was NOT supposed to be charged monthly checking fees for two reasons:
    1.) I have mortgage with BAC.
    2.) I was grandfathered into free checking when BAC acquired LaSalle bank (this was an employee benefit for
    LaSalle employees).

    When I called BAC about the increase and late fee, a CSR disputed my case stating that the rate increase and fees were charged because I missed my payment billing cycle of 28 days. The billing cycle was changed from 30 days to 28 days, he stated. (I was unaware that the billing cycle was modified from 30 days to 28 days.)

    I disputed this because I set up automatic payments to meet the billing cycle dates. This attributed to a late payment OVER A WEEKEND. The CSR would not listen to my plea, saying he didn’t care. I stated I would close my accts. He stated that would be fine with him. At which point I went to my local branch and asked to close my accts. I was then told by the branch employee that customers having mortgages were not charged the checking fees. I asked to close them anyways because I could not be a customer of a bank that treats long standing customers in that manner.

    Now, for the surprise! On this recent bill I shouldn’t have received I find the billing cycle is 30 days! What happened to the 28 day billing cycle that the CSR stated I missed?

    I believe I have suffered enough. Please remove the outstanding $9.38 that is in this acct. and close it.
  • Bank of America fired my wife for no good reason at all. She gave eight years to them and they canned her on some trumped up charges, despite the fact that she was a top performer who earned free trips two years in a row.

    I hate Bank of America and I'll do whatever it takes to make them look bad. I'll retweet ASAP.

    Wells Fargo did the same thing to me...apparently over drafts in Las Vegas, where I opened the account are not the same as they are in Texas, where I now live. They charged my account in over draft fees until the amount was $1000.! They closed the account. I opened an account at BofA and two weeks later, BofA closed the account saying I had been reported to some company and they were closing the account to protect themselves from me. They held my money for almost 30 days before they sent a check for the balance of my account. And when I complained, BofA said they could hold the money for as long as they wanted... and now I can no longer open an account at ANY bank. Which is no problem for me....I cash my check at BofA because that's where it's drafted from, they charge me $6 for the service ANOTHER rip off, and keep the money in my safe at home. I pay everything with cash, closed all my credit cards and now don't worry about any of the banks OR credit card companies....Anyone who continues to bank with any of these big banks should really think about moving their money into a local bank that deals only in the state they live in....there are plenty of them and the service is unbeatable.

    I experience the same thing with these 35.00 fees. The debits I acquired was for like 5.00 , 5.00 and 6.00 transactions over the weekend at the gas station. I called customer service and told them I had sign up for over draft protection on-line from my savings. They told me each transfer from my savings would cost 10.00. After about 6 days I got mad because my fees grew to about 400.00. I went to the bank and withdrew my savings. I can't afford these bank extortion tactics. I today only have a Saveings with a diffrent bank a debit with a diffrent intstitution. No checking account at all. I pay my bills with money orders. I can't afford these bank hussles.

    Bank of America are extreme predatory lenders and it is no joke. I am a retired military officer and I have been victimized by them. When the fuel prices reached four dollars, I cosigned for a loan for my brother who owns a small delivery company and employees his two sons. The sons have six kids between them, and they were in real trouble. The economy worsened and my brother fell delinquent on his loan. He struggled to make the payments, unknown to me, but not before the Bank of America imposed a MANDATORY PENALTY INTEREST OF 29.99% INTEREST because of his late payments TOPPED with a $35 LATE PAYMENT FEE, TOPPED with an additional penalty because the payment was less than required. This small business was struggling just like AIG, BIG BANKS, and everybody else. He had to feed his family and try to keep his business afloat. So, he now has a $50,000 loan balance with the BANK OF SCREWMERICA with $24,000 of it in BANK FEES ALONE. The other is legimitate charges. Don't forget, they got BALE (as in hay in this case) OUT FUNDS from OUR GOVERNMENT. Ohhh, Say can you see, by the dawns early light,.......................they are bank robbers behind desks getting paid high salaries.

    THANK YOU BIG ROBBY! I hate these BOA people! I have about 6 accts with them, plus a credit card. A couple of months ago, I started getting hit with a monthly $25 maintenance fee. Turns out that even though I meet their minimum requirement for free checking, because 3 of my accounts were opened in a different state their balance cannot be considered for my combined balance with no fee! I have plenty of money with these people and because I moved from NY to NC and opened additional accts, the supposed bank computers cannot handle this...I see ALL of my accounts when I use PC banking. My PC is better than yours. Why should I be inconvenience and penalized. WTF!? Screw BOA!

    I guess I will leave my 2 cents about B of A as well, since yesterday they verbally turned down my refinance that has been in their hands for 4 months. My wife and I both have credit scores over 750. We were looking for some equity back to eliminate some credit card debt and free up extra monthly money. Our payment would have gone up only $60, and we would have had an extra $1500 in hand each month from not paying the card bills. Yet they said we would not be able to make the payments. What's up? Their only answer, verbal mind you, is that I am self employed and because of all my tax deductions they do not believe I have enough disposable income to make the extra $60 payment. We have 2 mortgages with them and have never been a day late, nor with anyone else. Give me a break! My wife thinks she has the answer. When we applied for the refinance we locked in at 4.875. They drug their feet, and the rate is now around 5.4. It would cost them money to approve our loan now, so they found a way out, though so far they refuse to give us a reason in writing for declining our loan. Then they had the nerve to suggest that there might be a program we could switch to that would get us approved, though it would be at a higher interest rate. How can an institution that large get away with this crap? I am so ticked about this I'm considering checking to see if there is any legal action. I have never been turned down for a loan in my life, and this is insulting!

    Bank of America AKA the Former Countrywidedoes not care about you or anyone else. Here is an example at 81 years old I ran into financial problems and got behind on my mortgage. I was making arrangements to refinance but was coming up short to close by 5 thousand dollars. I offered to pay off the loan amount if they would forgive the $11,000.00 in interest penalties they tagged on in 4 months. Their answer is they would rather have a home go into foreclosure, pay all the legal fees (more than the $11,000.00), maintain the house and sell it at a loss at auction than get at least the loan amount back. I gave up my life insurance and all I had to get my re-finance done. Bu8t if anyone is considering any action with Bank of America--DON'T DO IT! Close all your accounts, change you mortgage and run for the hills.

    It's about time someone sounded off about Bank of America's practices. They twice in a week's time tried to clean out my bank account and were successful the second time, without my knowledge or consent. It wasnt until three days later that I caught on and had to raise thousands of dollar to cover the legitimate checks I had written. They insisted I logged on to their website and authorized two months of mortgage payments to be debited from my account. I think not. Anyone using their website, BEWARE!

    In addition, when I proactively called them FOUR times to discuss a reduction in my mortgage payment and wasnt yet in arrears, they basically laughed at me. THEY TOLD ME THAT I DIDNT MAKE ENOUGH MONEY FOR A LOWER PAYMENT. Now I am in arrears because they were unwilling to work WITH ME. They apparently want more foreclosures to contend with. And even though I had never been late on my mortgage (and never had any issues when it was owned by Countrywide) they were completely unwilling to negotiate or help. They can have my house...at this point I dont really care. Screw them!

    I hate boa! They are still trying to get fees from me after I already paid those fees. I am raising my 3 grandsons and one is disabled. I now have no money to buy groceries or put gas in my vehicle. I have proof I paid those fees and showed that to them and I was told to leave. They are still charging me. I had closed my account but they are pending that until I pay those fees and are adding more on to them. My daughter has now gotten to the amount of over 2,000.00 just in fees after she closed her account. I am taking ours to an attorney. They have been sued for this once before and they lost but the customers only got 78.00 back from them as there were so many of them. So customers still lost. Because of all of this it goes on your credit rating so it shoots that to hell too. Glad you did this blog.

  • Dude - You have no idea the amount of customers I am going to convince to stay away. Until I get my money back, I am making it my personal mission to get this discussion rolling. If there isn't a website out there dedicated to Bank Of America screwing people and the awful stories, there will be tomorrow. I'm going to take every penny they charge me in fees and spend it on informing people of their practices. They overcharged the wrong dude.

  • I agree- the credit union here is so reasonable, that a client bounced 2 (COUNTEM) TWO $5000 checks. They cleared instantly with the Credit Union and the money was spent. They waited PATIENTLY for 19 days and charged me a $7 (SEVEN DOLLAR) under-balance fee. For a $10,000 negative balance for 19 days. Bank Of America on the other hand is charging me $300 for $5 overage. FUCK YOU BANK OF AMERICA.

    BoA took over banks I had credit card debt with. Now they send a letter the former fixed rates are going adjustable. Called them to opt out, they said no. Asked why. Its the policy not to. When rates go up my payments stop.

    The same thing happened to my son (20). They would not return the fees, I went with him to BofA, asked for a refund, said they couldn't do it, asked for the next person in charge (went thru 3) finally at the top (manager) I was able to get a refund of all the fees. I just had to be patient. However, they never should have charged them to start with.
  • Man, that really stinks. Banks are really acting like douchbags these days and to add insult to injury, Americans still are expected to bail them out when they can't keep their businesses running. Would we bail out a casino that went under? Heck no. Why should we do the same for these crackpots.

    I switched to prepaid debit a while back because I kept getting stupid overdraft fees and couldn't take it anymore. Of course, the banks are buying some of these operations up, too, but you can still find smaller operations and if you use them right, maybe even save yourself the hassle of situations like this. I dunno.

    You are so right, man...I've had Bank of America accounts for about 5 years now and they are just ridiculous with the fees. If you have charges that come in weeks after you bought the items, and overdraft, they will charge you $35 for each time -- even if you went over $0.25. Seriously, I accidentally went over my account by $0.25 -- and I put the money back in there 3 hours later when I realized what happened -- and they STILL charged me $35. Over 25 freaking cents!

    I would switch over but from what I hear, most if not all big banks are like that. They screw over customers with outrageous fees over tiny, stupid stuff. And they e-mail you about everything else, but when you go over your account balance they send you a letter in the mail. Which doesn't get to you until a week after you go over. WTH?

    I would much rather my card get declined because I don't have enough money than them take $35 per transaction because I didn't realize something went through a week later than it should have, or something. This is why I check my bank account every single day because they suck and I'm not trying to get in a pissing contest over 25 cents with them again.

    I just want to add - apologies for misuse of English language...but had to vent. still no excuse. Regardless, I agree with knowing your balance. And I do. Fact is, managing funds these days - even in my best/worst financial situations can be off track here and again. In the past, BOA was generous to remove fees - whether all or just a couple. And fortunately, I only lost track about 4 or maybe 5 times in my life with BOA, previously Fleet, previously Nat West - SO here is the situation - while banking with the same institution regardless of name (17 years in fact) their ability to recognize long term customers and their banking history has declined to a massive machine style treatment. Ok, banks are hurting - we all are - but lending home loans/other to anyone that could fog a mirror (stated income (lies) with crud credit scores) was not my fault. Their lending practices bit them - so now it is time to make customers like me pay??? again, those fees - while outrageous - are not reasonable if taken in the context of my banking history. Even still, if that was their new (lame) methodology, fact remains that I was told the previous day(s) that "no Matt, you would not have any overdraft fees applied." But they did. I am paying for their misinformation. It is just wrong. Too bad someone couldn't steal the Glengarry leads from them...then they might know how it feels. ugggh, just a pawn in this messy recession...

    @steve - Dude, I'm a developer, and I know that a company like BOA can eliminate this abuse by implementing a $1 million or $2 million dollar process. They could then, say, charge $1 one time or even a month to guarantee no fees like this. This would make them a fat chunk of money, and would be a reasonable way to prevent this bullshit.

    Many people who have commented on this topic around the web and disagree with me bring up the same topic - "You're an idiot for not keeping track of your balance". I don't disagree. Let's be realistic - I use my card exclusively. I don't use cash for anything except gumball machines and toll booths. I have several accounts depending on how clients want to pay, so its inevitable a mistake would be made. Yes - it is, in the end, my fault for not paying attention - so charge me $35. NOT $280. That's a no-brainer.

    Others say I'm looking for hits to my blog - when I should be talking to a manager. I also don't disagree - I am looking for hits. More hits means the topic is discussed. It also means that I'm not the only one with these problems.

    I'm looking to take advantage of social media's nature and spread the word around. There's no denying my responsibility in this, and I stated clearly that I was willing to pay a fee or two, but almost $300 and growing on a $5 overdraft? That's criminal in my book.

    Banks make a huge profit off their overdraft policy, $34.5 Billion in fees last year alone. They charge you to give them your money to hold, which they earn interest on. They give you terrible interest rates on accessible cash. The list goes on. How else can they make up for their losses from their irresponsible lending practices over the last 10 years?

    I've tried to reason with BOA to no avail, so it's my turn to talk. It's their turn to listen. And if my post is getting hits from this issue, it's simply because I'm not the only one with this problem. I appreciate all the voices, whether you agree or not. I'm just happy it's being talked about.

    BOA SUCKS!! They have me reported to ChecSystems for a bounced five dollar check from 1999. I paid the check off the day I had realized it bounced (I was 18...it happens.) That five dollar check cost me $75.
    When I tried to switch banks, ChecSystems still has that check pending unpaid per BOA. However, calling BOA, they claim there is nothing there. Every person at the "Customer Service" call center is RUDE. I requested a manager and one kid told me, "I AM my manager...Have a nice day."

    This has gone on for 8 years!!! It has finally gotten so bad that I would rather keep my money in an effing shoe box under my matress.

    Steve you have GOT to be kidding me, NYTimes reported that banks are making a projected $35 BILLION on overdraft fees ALONE this year. They are counting on these fees for upwards of 10-20% of their revenue (depending on size) from these fees. They are increasing these fees during the recession in order to maintain their revenues and not spook financial markets to see their stock drop, capital drop, then need more capital via private investors which will charge a hefty interest rate for the risk of investing in these "zombie banks" or they could look to the government for more capital, which is a last resort because they don't want execs to have pay requirments or have gov't have a say in how they run their business. They are looking for anyway to eek out a profit to look good to wall street, bottom line.

    Read closely the agreement that is signed whenever you open a checking account. I don't have the document with me right now, but under the overdraft section it basically says that they have the right to order any transacations in any order they want. BigRobby, read it, and post it on this blog, I am not home right now or else I would. I will visit your site and give you the information if it's not already posted. When I read the language, my jaw literally dropped, because I thought it was illegal, and such practices were reserved for gangsters and loan sharks. I am a finance major, this is my field of study, I really think people need to be informed of the incentives that run these financial markets. These fees prey primarily on the lower class and are extremely exploitative to say the least

    BoA bought my mortgage company, so I am a "customer" of theirs now. Sucks! Oh, I am a member of an employee credit union and their fees are BS just like the fees I get at my local banks, Chase and National City (which has been bought by PNC). I need to find one of the kinds of credit unions about which you guys have spoken. My CU (MEFCU) charges you to use their Bill Pay service and they charge you a $4 fee if your account is under a certain $$$ balance. They charge unauthorized ATM fees and overdraft fees, too. Oh, and let us not forget that they charge account holders $3 for each transfer that they have to make from your savings to checking to cover a debit or check transaction. So much for me being a part owner in a credit union. They screw me just as much as a bank does.

    My two BoA stories:

    1) I had a secured credit card a few years ago in order to help my credit score. The annual fee for a secured card is $29, and it unsecures after about 6-9 months. Well, mine unsecured at nine months. But guess what? I'm still paying the $29 annual fee for the secured card! I was snidely told that if I had a problem with it, I could close the account and apply for a new card, which I CAN'T do because it's my oldest credit card. So now I pay $29 for the privilege of having a shiny credit card sit in my underwear drawer.

    2) The ATM machine went down while I was putting money in my account. That happened to me just two weeks ago. The bank said there was nothing they could do and I needed to take it up with the makers of the ATM machine!!!! After raising SERIOUS hell, BoA was kind enough to give me a temporary credit while they "investigate" the matter. What kind of stupid shit is that? Don't all ATMs have CAMERAS? The worst part is that I can't even close the account until the effing investigation is over! And as soon as it is - and I'm sure it'll be ruled against me - I'm taking my business elsewhere. At this rate, I can't AFFORD to be a BoA customer!
  • I'm int the exact same situation, only for me I took money out of my savings and put it into my checking. The bank canceled the transfer so they could charge me overdraft fees, then they put a fee in my savings account so I'm in the red on BOTH accounts.

    I really don't know what I'm going to do. I called and they were extremely rude. I'm done with this bank.

    You think its free to B of A to allow you to use that debit card? You think all that technology and the entire interchange infrastructure just magically appeared one day so you could have a convenient way to pay for things? The technology is expensive and the business model is make money by using the deposits in your accounts. Thus for people like you who don't carry a large balance, they make no money off of you other than fee's.

    This is why you, and from what I can tell, most other people who have commented here, have a lot of bad news coming in the next year. The banks don't make money off of you, so when your credit card accounts start getting closed and the rest of your accounts start having annual fee's tacked on, try not to be surprised.

    And here's a little lesson in debit card authorizations since you seemed so up in arms that B of A would let the transactions through. Debit cards don't have an authorizations strategy other than the confirmation that the card is legit. Its the same thing as writing a check. The whole point of a debit card is to provide you direct access to your funds without having to go through an auth strategy. Of course B of A could implement an auth strategy on their debit cards, but again, technology isn't free. Why would they spend all the development dollars to implement the auth strategy when the vast majority of their customers wouldn't want it. And if you think its some simple code fix then you just have no idea how these systems work and the amount of testing and preparation needed for the cut over period.

    And honestly lets think about this. You want B of A to spend thousands and thousands of development hours to implement an auth strategy that would eliminate millions of dollars in revenue from the fee's. How would a project like that ever get greenlit?

    But anyways the thing I don't get is why you are so mad at B of A and not the video store. B of A has a very clear policy: "you overdraft, you pay 35$ per transaction" It is not their fault your video store sent them 5 separate transactions. How are they supposed to code their system to account for this? And why would they wave the fee's. Its hilarious that you are so surprised that they won't wave the fee's to keep customers. You want to know why? LIke I said above, THEY MAKE NO MONEY OFF YOU AND WANT YOU TO CLOSE YOUR ACCOUNTS.

    Please stop pretending like are doing B of A some great service by having your account there. If your account had the "this customer is profitable for us" flag on it, those fee's would have been waved the first time you called. Banking is changing as there's a lot of bad news coming for you so I think you should just relax.

    A pretty famous financial guy named Dave Ramsey talks about this all the time. His term for them are "vipers", and "I never mess with vipers". Somebody above said it right: Join a Credit Union. The thing about credit unions is that you need to be in something to join them. If that is not an option, join a small local bank, with few branches. Remember: These banks were the smart ones during the "bailouts". If your bank, in the future, gets gobbled up by BoA, Citi, Chase, etc., then pull your money and find another local "community" bank. You never get these fees nonsense with these banks. Ridiculous.

  • @Geoff - yeah, I never denied what I did was my own fault, and was willing to pay 1 - MAYBE 2 fees, but after that it's just wrong. But my best advice to anyone, besides avoiding Bank Of America is KNOW YOUR BALANCE. And maybe 'always make sure there's an extra $100 that you don't need in your account so you're covered when the fee nazi comes looking for anyone out of line.

    Same problem. I did a wire - they held it for over a day (even though wires from my trading account are backed federally and should be recognized immediately). I saw pending payments in red, but no transaction fees (since my deposit/wire was pending). I spoke with customer service (morons) and they said "no problem, no fees will be applied." - so, no necessary immediate actions to comer that - right? wrong. next day after that, wire confirms, and 5 $35 fees applied. Spoke on the phone all day for an hour w customer service - several people/managers. Answer was tough sh. Still trying to get copy of ph conversation from previous customer service rep. Also, 2nd cust serv rep started talking condescending - so, when I asked to speak with someone else, they made me hold for 30 min, then went to voice mail. Still have not heard from them. BOA sucks sucks sucks sucks sucks sucks sucks sucks sucks sucks sucks sucks sucks sucks. They f-n suck. ANy recommendations for better bank (w/business services & decent fees) in SoCal?

    There are two ways to get your overdraft charges refunded.

    #1 Send a short but detailed email describing your situation to as many BOA executives email addresses that you can get your hands on. I found a blog where a guy posted about a dozen BOA executive email addys. You have a VERY good chance of getting a response back within a few days with an offer to refund the charges (unless you rack up over draft charges all the time).

    #2 In the unlikely event that sending those emails doesn't work you can always file a claim in small claims court. It's easy to do, is inexpensive and you don't need a lawyer. Once BOA gets notice that you have filed against them in small claims court they will likely call you before the court date and agree to refund the fees and your court costs. It's MUCH cheaper for them to simply drop the fees then to show up in court.

    Try sending an email to these BOA executive email addys. Be detailed in your short email and tell them you feel mistreated and will take your business slewhere if they don't remove the fees from your account.

    FYI: BOA charged me a $35 overdraft fee ten times one day ($350 total). This happened a few weeks ago. The fees hit my account on a monday. I called customer service and a local branch and they were no help at all. I spent monday researching online and discovered that sending emails to the top level executives can often times result in getting the fees removed. So I sent an email monday night to the same addresses I posted here. The next day a rep from their executive customer relations dept called and removed the charges from my account.

    Follow my advice and I would be shocked if you didn't get the fees removed from your account.
  • How about I got hit with three overdraft fees for being overdrawn for THIRTEEN MINUTES, long enough to say "Oh crap, I'm overdrawn"? I didn't even think that was possible!

    BoA is the only bank account that I've ever had where I've been AFRAID to spend money. (Thank GOD my mother qualified me for Navy Federal.) I check every single day to make sure that raggedy-ass $13.55 is sitting there. The only reason why I even have is because I'm nowhere near an NFCU location. The craziest thing is that BoA is what...one of the largest banks in the world? And they're harassing you over FIVE DOLLARS?

    Join a credit union and don't pay them SHIT!

    SAME EXACT THING happened to me this month. $350 dollars in fees plus the insult to injury $35 for persistent overdrawn account. "Nothing they can do" says the supervisor, except the helpful suggestion of sending me a check register to better keep track of my finances. My first overdraw was 8 days ago and I JUST got the notice today. They've charged me 10 times since then.

  • Bank Of America is a piece of shit. They actually rearrange the order in which shit clears JUST to make sure they make overdraft fee money from you. I fought them on this years ago and things did change slightly, but its still going on today. If you have $0 in your account, and you post 1 deposit, and 3 debits that day they are supposed to technically clear at midnight. If you watch though, they clear the debits BEFORE the credits just to rip you off. Even if you made the deposit before authorizing the debits!!!!!! I am fighting them on one right now. It's disgusting!!!!!

    Unfortunately, this is every bank. Same thing happened to me this past Christmas! 11 overdraft fees at $35 each plus an added $7 a day as a penalty for my account being negative. They made a shitload of money off of me. Man was I pissed. I think it was something like $700 worth of charges for less than $75 worth of stuff. They would only remove 2 Read More of the charges. I remember my paycheck was automatically deposited, sucked up by the bank, and I didn't have any money for like a month and a half (thank God for student loan cards). This was when I was in Maine for xmas, by the way. I had no idea anything was even going on with my account. As far as I knew my paycheck was automatically deposited (it was delayed because of the holiday) and I have several hundred dollars in the bank! It was my own fault for not double checking the balance. I get that. But their fees are ridiculous. I asked the supervisor why they didn't just decline my card...he said it's not their policy to "embarrass" their customers. Like it's not fucking embarrassing when you're hundreds of dollars in debt. I asked him how many times the band would let me use my card before someone notified me by phone, check, email, WHATEVER, that my balance was negative. The answer is that they send a letter in the mail within two weeks of the first charge.

    So, it's not about keeping customers. It's about screwing all the people dumb enough to not to check their balance everyday...which I'm totally guilty of. I think it's evil, but who knows. I heard Obama talking about some bill making it illegal to do that....but it was a while ago.

    I also wanted to add that you should check your bank to find out the latest that you can deposit a check (since you mentioned you have checks from Father's day, x-mas, etc.). My bank will only accept checks less than 90 days old and so we were totally screwed when I went to deposit some of the checks we received at our wedding. I think ... Read Morewe lost $400 bucks or so. It's a long story, but we have separate accounts and the checks were written in my name. Andy's bank wouldn't allow him to deposit them in his account, and my bank wouldn't accept them either because they were written with my new last name. I couldn't change my name at my bank without doing it through SSN and the DPS office first, and of course that was a huge fucking disaster. So long story short, once it was all figured out it was too late.

    Seriously, every time I hear another one of these stories of predatory lending, it just inspires me to keep my meager funds in a coffee can. The banks are raping the working class. 75 percent of us won't notice or complain. Those smart enough to question the policies will be told, in bank speak, to fuck off. Way to help snap us out of this economic funk, you scumbags. Bank of America, my ass. Bank of Greed and Narcissim, more like it.
